Trademarks

Holland & Hart's trademark practice group encompasses a wide array of specialty areas. In addition to assisting clients in searching and clearing trademarks, we partner with clients to develop domestic and international enforcement and registration strategies aimed at maximizing the scope of rights for our clients' trademarks. Our attorneys also focus on Internet law, including domain name and online marketing, promotions, sweepstakes, and privacy issues. We have a substantial licensing and entertainment law practice where publicity rights, sponsorship rights, and trademark rights are defined, managed, and licensed.

Domestic Trademarks

  • Searching and Selection
    We work closely with our clients and their marketing groups to assure that the most distinctive and defendable trademarks are selected. We pride ourselves on our fast turnaround for preliminary searches for the U.S., Canada, the United Kingdom and the European Union trademark office. As a result of our extensive volume of our trademark work, we receive (and pass on to our clients) significant discounts from our outside search vendors.
  • Registration
    Holland & Hart has lawyers experienced in all aspects of U.S. trademark registration, including the filing of use-based, intent-to-use, section 44 applications and incoming and outgoing Madrid Protocol applications, trade dress registrations, divisional applications, audible marks, and applications to the Supplemental and Principal Registers. In addition, we have broad-based experience in Trademark Trial and Appeal Board proceedings (both opposition and cancellation proceedings).
  • Docketing and Extranets
    Whether you have only one trademark registration in the U.S. or hundreds of registrations throughout the world, we appreciate the importance of keeping track of the renewal and maintenance deadlines and of our clients being able to access their files. Consequently, we commonly maintain our files in electronic format and provide our clients with securely encrypted access to those files on a web-based extranet site. Our extranets allow our clients or designated foreign counsel to have virtual online access to all or selected trademark application or litigation files. This seamless access facilitates improved collaboration and cost savings. We also have devoted substantial resources to maintain our intellectual property docketing system. This system adds substantial value to our trademark services.
  • Proper Use
    Once a mark is adopted, we work closely with our clients to develop understandable trademark use guidelines for internal use and for our clients' licensees. Proper use is often the key to maintaining a trademark's equity value.
  • Scope of Rights and Trademark Watching
    At Holland & Hart, we work to tactically define the scope of rights or potential scope of rights that exist in our client's marks, using our Scope of Rights Table (SORT) technique, we visually explain the scope of rights to our clients. Once that trademark turf is defined, we assist in developing trademark and web watching systems to allow our clients to continuously monitor any potential infringement activities worldwide.

International Trademarks

Our trademark lawyers are responsible for applications and existing registrations in approximately 140 countries throughout the world. Taking advantage of our size, we have developed our own network of foreign counsel, all of whom specialize in trademark law within their respective countries.

We have substantial experience in developing focused strategies for international brand asset management, taking advantage of the many types of registers and systems available under the European Union's CTM office, the World Intellectual Property Organization (WIPO), the Paris Convention, Madrid Protocol, North American Foreign Trade Agreement (NAFTA) and the World Trade Organization's Trade- Related Aspects of Intellectual Property Rights (TRIPS) agreement.

  • Enforcement and Anti-Counterfeiting
    If and when our clients' trademarks are infringed upon, we stand ready with more than a dozen lawyers experienced in enforcing our client's trademark rights and domain name rights in most of the United States. We also work closely with our clients, investigators, foreign counsel, and border control agents around the world to watch for, seize, and destroy counterfeit goods worldwide.
